MELTH / COMPANY INFORMATION

Terms of service

The general terms that apply when a business uses MELTH AI, MELTH Channels or MELTH Commerce.

Last updated 21 October 2026

1. About these terms

These terms apply to agreements with MELTH, a Dutch sole proprietorship registered at Bankraspad 12, 1184 TW Amstelveen, the Netherlands, Chamber of Commerce number 67261892 and VAT number NL002054578B78. Contact: melvin@melth.nl.

A written proposal, order form or service-specific schedule may add to these terms. If documents conflict, the signed proposal or order form takes priority for its specific subject, followed by the applicable service terms and then these general terms. Mandatory law always prevails.

2. Business use and authority

MELTH AI and MELTH Channels are offered primarily to businesses. The person accepting a proposal confirms that they may bind that business. Consumer purchases made through MELTH Commerce are governed by the seller's offer, the Commerce terms and mandatory consumer law.

3. Proposal, price and payment

The service scope, price in euros, VAT treatment, billing interval, start date, term and any usage or third-party charges are stated before acceptance. An application or demonstration is not an order. Invoices must be paid within the period stated in the proposal or invoice. We may suspend affected paid services after reasonable notice if an undisputed amount remains overdue.

See Pricing & payments for the public explanation of our pricing model.

4. Customer responsibilities

  • Use MELTH lawfully and only within agreed permissions.
  • Keep accounts, credentials and recovery methods secure.
  • Ensure that uploaded data and instructions may lawfully be processed.
  • Review AI output, recommendations, listings and proposed actions before relying on or approving them.
  • Do not attempt to bypass security, access another tenant or use the service to harm people, systems or rights.

5. Data, confidentiality and privacy

Each party protects confidential information with reasonable care and uses it only for the agreement. The customer retains rights in its data. The customer gives MELTH the limited rights needed to provide, secure and support the service. Personal data is handled as described in the Privacy policy and, where required, a data processing agreement.

6. Intellectual property

MELTH and its licensors retain rights in the platform, software, documentation, design and underlying technology. The customer retains rights in customer materials. Rights in commissioned deliverables are stated in the accepted proposal. Third-party services and generated materials may have their own licences or restrictions.

7. Availability, changes and support

We use reasonable care to keep agreed services available and secure. Maintenance, third-party outages, marketplace changes and events outside reasonable control can affect availability. Material service changes are communicated through the agreed channel. Support level and response targets are those in the proposal; otherwise reasonable commercial support applies.

8. Term, cancellation and exit

The term and notice period appear in the accepted proposal. Either party may end an agreement for a material breach that is not cured within a reasonable stated period, or immediately where continuation would be unlawful or create a serious security risk. On termination, payment obligations already incurred remain due. Data export, deletion and transition support follow the proposal, processing agreement and applicable law.

9. Liability

Each party remains responsible for foreseeable direct loss caused by its attributable breach. Unless a signed proposal states otherwise, MELTH's aggregate liability for a contract year is limited to the fees paid for the affected service in the 12 months before the event. This limit does not apply where limitation is prohibited by law, including intent or deliberate recklessness. MELTH is not liable for business decisions made without the required human review, customer-supplied errors or third-party platform failures outside its control.

10. Complaints, law and disputes

Send complaints through the contact page. We normally acknowledge them within two business days and aim to resolve them promptly. These terms are governed by Dutch law. Parties first try to resolve a dispute in good faith. If that fails, the competent Dutch court has jurisdiction, except where mandatory consumer rules provide otherwise.
